After The Event (“ATE”) Insurance Disclaimer - FAQ’s
| Which policies have been disclaimed? | The joint administrators have disclaimed all active ATE insurance policies underwritten by Elite, with the sole exceptions of policy number 3/16/739278 and 1/17/757700, have been ‘disclaimed’ by the Administrators in accordance with the Gibraltar Insolvency Act. |
| How does the disclaimer affect policyholders? | This disclaimer terminates with effect from (and including) 11 December 2020 all ATE policies,with the sole exceptions of policy numbers 3/16/739278 and 1/17/757700, meaning that Elite is no longer providing ATE insurance cover. Under Gibraltar’s Insolvency Act, policyholders, and any other person whose rights are affected by the disclaimer, can submit a claim in Elite’s administration for any loss or damage they suffered as a consequence of the disclaimer. | Who can submit a claim? | Under Gibraltar’s Insolvency Act, policyholders, and any other person whose rights are affected by the disclaimer, can submit a claim in Elite’s administration for any loss or damage they suffered as a consequence of the disclaimer. |
| When can I submit a claim? | The Administrators will communicate with relevant policyholders in due course with information on how to submit a claim for damages. There is no requirement to submit such a claim immediately. |
| Will my claim be covered by the FSCS? | The Administrators are working and will continue to work closely with FSCS to determine the availability of FSCS protection, subject to their eligibility criteria, for claims arising prior to the date of disclaimer as well as for damages arising as a result of the disclaimer. |
| What action do I need to take now? | Policyholders, and any other person whose rights are affected by the disclaimer, should try to minimise any loss they might suffer as a result of the disclaimer. Policyholders might, for example, be able to find alternate ATE insurance cover. |
