General Update - LBIE Client Information Portal Enhancements - User Obligations - 21/04/2011

Further to the 5 April 2011 General Update, please be advised that in preparation for the introduction of additional functions to the Client Information Portal ("CIP"), LBIE is facilitating enhanced CIP security measures scheduled to be made on the 18th May 2011 ("CIP Enhancement Date").

One of the main enhancements to the CIP is the introduction of unique individual user access (vs. unique counterparty access). From the CIP Enhancement Date each user will be given by their Administrative User (see below), their own bespoke user name and password. Each user will be prompted to change their password on a frequent basis and no two users will be able to simultaneously logon to the CIP using the same access details.

In order for the enhanced security measures not to affect a counterparty's access to the CIP (and the sub-portals) on the CIP Enhancement Date, all counterparties should comply with the instructions below:

1)  A primary contact ("Primary Contact") must be designated as the Authorised Representative for each counterparty represented in the CIP by a client code ("Legal Entity").  A Primary Contact cannot be a group email (e.g. legal@xyz) or a generic title (e.g. info@xyz; companysecretary@xyz).  An "Authorised Representative" means as an individual acting on behalf of a legal entity that is or was a client of Lehman Brothers International (Europe) (in administration) ("LBIE") and who is validly appointed pursuant to the relevant provisions of that legal entity's constitutional document to enter into legal, valid, binding and enforceable obligations on behalf of that legal entity in connection with its relationship with LBIE, without prejudice to the generality of the foregoing, including such individual having the legal capacity to sign a proof of debt in respect of that legal entity in accordance with Rule 2.72 (ix) of the Insolvency Rules 1986. It being understood that where the legal entity itself is an individual, the Authorised Representative can be either such individual or another person validly appointed by such individual. It further being understood that a Primary Contact may also be the Administrative User if so authorised by your Legal Entity.

2)   It is the role of the Primary Contact to then:

a) Certify their status as the Authorised Representative of their Legal Entity and agree to the CIP's General Disclaimer & User Guide and the Authorised User Representations; and

b) Designate an administrative user ("Administrative User") for the Legal Entity in advance of the CIP Enhancement Date. From the CIP Enhancement Date, the Administrative User will issue and manage logons for the Legal Entity's user population, including the Primary Contact, each secondary user (i.e., an Authorised User of the Legal Entity who is neither the Primary Contact nor a third party delegate) and any third party delegate for that Legal Entity.  The Administrative User should be an individual, authorised by the Legal Entity, and must not be a group email (e.g. legal@xyz) or a generic title (e.g. info@xyz; companysecretary@xyz).  Note: a Primary Contact may also be the Administrative User if so authorised by the Legal Entity.

Please note that if a Primary Contact and Administrative User have not been certified and designated by the CIP Enhancement Date, access for all users from that Legal Entity to the CIP (and the sub-portals) will be disabled.

Please ensure that your Legal Entity logs on to the CIP https://dm.pwc.com/LBIE_CIP/ as soon as possible using their unique username and password previously provided by the Administration and completes the required steps needed to certify the Primary Contact and to designate an Administrative User. Failure to complete these instructions will result in the Legal Entity's access to the CIP (and the sub-portals) being disabled as of the CIP Enhancement Date.
