Update – Waterfall II Application (the "Application") – Parts A & B Appeals - 20 January 2016

Pursuant to the permission to appeal granted in the Part A Order and Part B Order of Mr Justice David Richards, the respondents filed Appellant’s Notices and Grounds of Appeal on 13 November 2015, copies of which can be found below:

• The Senior Creditor Group’s Appellant’s Notice and Grounds of Appeal in respect of the Part A Order:
• Wentworth’s Appellant’s Notice and Grounds of Appeal in respect of the Part A Order:
• York’s Appellant’s Notice and Grounds of Appeal in respect of the Part A Order:
• Wentworth’s Appellant’s Notice and Grounds of Appeal in respect of the Part B Order:
  

On 23 December 2015, Wentworth filed its appellant’s skeleton argument in respect of its Part B appeal. A copy of this skeleton argument can be found here.

On 4 December 2015, the Court of Appeal ordered an extension to the deadline for the filing of skeleton arguments in respect of the Part A and Part B appeals. A copy of this order can be found here.

The skeleton arguments will be filed in accordance with the following timetable:

• The Senior Creditor Group and Wentworth’s appellant’s skeleton arguments to be filed by Monday 1 February 2016;
• York’s skeleton argument to be filed by Friday 26 February 2016; and
• The Joint Administrators’ respondent’s skeleton arguments to be filed by Thursday 31 March 2016.
