Update â Waterfall II Application (the â Applicationâ ) â Skeleton Arguments in respect of German Law Issues for the Third Tranche Hearing - 9 November 2015

Pursuant to the order of Mr Justice David Richards following the case management conference held on 9 March 2015, a pre-trial review (the “PTR”) was held on 9 October 2015 before Mr Justice Hildyard in respect of Tranche C of the Application. Further to the PTR, the parties agreed, and the Judge approved, a directions order which was sealed on 30 October 2015 (the "PTR Order").  A copy of the sealed PTR Order can be found here.

Further to paragraph 9 of the PTR Order, skeleton arguments in respect of Issues 20 and 21 were filed and served in advance of the hearing of the third tranche of issues in the Application which commenced on 9 November 2015.  Accordingly, copies of these skeleton arguments in respect of Issues 20 and 21 can be found below:

• Skeleton argument of the Senior Creditor Group
• Skeleton argument of Wentworth
• Reply skeleton argument of the Senior Creditor Group

No reply skeleton argument has been prepared by Wentworth.
 
As previously advised, the skeletons in respect of the remaining issues being heard in the Third Tranche Hearing were posted on 29 October 2015. A link to these skeletons can be found here.
