Waterfall II Application (the “Application”) - Third Tranche Hearing - further reports in respect of German Law - 5 October 2015

On 1 October, we notified you that, in light of the material changes to the arguments being made on Issues 20 and 21 of the Application, and the revision of Issue 20, the Senior Creditor Group and Wentworth agreed that their experts file and serve further expert evidence addressing the new arguments and answering a list of further questions. The Supplemental Expert Opinion of Dr Gero Fischer (for Wentworth), can be found here.  The English translation can be found from page 20. This report has been drafted to address the revised questions only. 

The Consolidated Exert Opinion of Professor Peter O. Mülbert (for the Senior Creditor Group) can be found here.  This is a consolidated report, reflecting Professor Mülbert’s amended opinion on both the original and revised questions.
